Buying or selling a home involves certain duties and responsibilities for both the buyer and the seller. Today we’re highlighting something that, as buyers, we must keep in mind when acquiring a property. One of the things we can assist with from Asergoi Our featured service today, which we will certainly comply with, is the Technical Building Inspection (ITE). This inspection is legally defined as an instrument and is contemplated in Article 52 of Law 3/2015, of June 18. Article 41 of the Housing Law establishes that owners of land, constructions, installations, and buildings have the duty to maintain them in proper conditions of safety, health, energy efficiency, public appearance, and decorum, carrying out the necessary work and repairs to conserve or improve them, in order to maintain the conditions required for their habitability, accessibility, or effective use, with energy and resource consumption within the limits established by regulations.

According to the Department of Territorial Planning, Housing and Transport of the Basque Country, The ITE is a visual inspection of the structure, facade and roof, and the common sanitation and supply networks, in order to know their construction characteristics, their condition and the pathologies that may affect the building.

The ITE is the tool used in the Basque Autonomous Community (CAV), and in the rest of Spain it is called the IEE (Building Assessment Report). In both cases, the objective is the same, and they also share the inspection areas, which are the conservation of the building itself; the Energy Efficiency – collection of data on the building envelope, as well as existing installations in order to certify the energy efficiency of the building or home, which must comply with current regulations – ; and the accessibility of the building or dwelling. That is, there must be compliance with the basic conditions of universal accessibility, and non-discrimination of people with disabilities for access to and use of the building, in accordance with current regulations; this includes establishing whether or not the building or dwelling is susceptible to making reasonable adjustments to meet these needs.

The ITE (Technical Building Inspection) culminates in a report and corresponding opinion prepared by a qualified technician. In the Basque Country we have This site for the information and management of ITEs.

The ITE (Technical Building Inspection) is mandatory when the building or home reaches 50 years since its construction, or when the owner wants to apply for public aid or subsidies to make improvements related to the aforementioned energy efficiency – facade and/or roof rehabilitation – or accessibility – entrances, ramps, elevator, stairs.

The cost of the technical inspection of the buildings will be borne by the building owner.
